CUSTOMER CARE PLAN
APPLICABLE IN THE STATE OF CALIFORNIA


(Hereinafter referred to as 'Agreement') Administered by the obligor ASTAK Services Company, a division of ASTAK Consumer Electronics Company, (ASTAK Services Company).

·In consideration of the amount paid by Customer and subject to the terms and conditions in this Agreement, ASTAK Services Company will be financially and legally obligated hereunder to effect service, including labor and all replacement parts necessary to maintain each specified product in good operating condition in the event of product failure, and, if applicable, specified maintenance services during normal usage without intervening external cause during the term of this Agreement (at either an authorized facility or on the site, as specified on the front of this Agreement). 'Intervening external causes' which are not covered by this Agreement include, but are not limited to loss or damage resulting from fire, water, windstorm, hail, lightning, earthquake, theft, riot, misuse, abuse, introduction of foreign matters (including but not limited to spilled liquid, sand, insect infestation), shipping, or physical damage. Maintenance services are limited to the following services: necessary adjustments; internal cleaning of video heads, tape paths and electrical contacts. This Agreement does not cover normal maintenance or adjustments due to Customer's inability to use the product, or the installation and set-up of product.


Service shall be performed only during servicer's normal working hours. This Agreement applies only to the product(s) specified in 'Product Information' when operated under the conditions for which they are designed, and shall not cover service required by external conditions such as, but not limited to, defective or inadequate power supply or power surges, antennas or antenna installation, problems with transmission lines, masts or supports, location of transmitting station or cleaning of any microwave areas or any cooking appliance. The replacement of any cabinet, cabinet parts or plastic parts (including dials, switches, and buttons) disposable bags, filters, belts, agitator brushes, batteries, antennas, ink film, toner cartridge, drum unit or the replacement of any lights, unless directly damaged as a result of component failure, is not covered by this Agreement. This agreement does not cover markings or retained images on the picture tube resulting from viewing fixed images or the replacement of LCD lamp units. ASTAK SERVICES COMPANY WILL NOT BE RESPONSIBLE FOR ANY LOSS, DAMAGE OR INJURY RESULTING FROM DELAY IN RENDERING SERVICE UNDER THIS AGREEMENT AND IN NO EVENT SHALL IT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

·(a) The price of this Agreement reflects factors such as the age of the product(s) and current service costs. (b) This Agreement is not automatically renewable. If a renewal contract is offered by ASTAK Services Company, the contract price will reflect the age of the product and the service costs at the time of renewal. (c) If on-site service is covered, ASTAK Services Company will effect on-site service only at the address on the face of this Agreement and it is possible that the product will be removed for shop diagnosis and/or repaired and then returned. On-site service requires clear, complete and easy access to the product by the authorized servicer and does not include removal or re-installation of an installed product. (d) Materials furnished as replacements for parts will be drawn from inventory of new or rebuilt parts or components. (e) ASTAK Services Company reserves the right to repair or replace, at its option, any covered products or parts thereof. Replacement parts and repairs are warranted only for the then unexpired term of this Agreement.

·This Agreement may be terminated in whole or in part: (a) BY THE CUSTOMER, with or without cause, by written notice to ASTAK Services Company (A) within sixty (60) days after receipt of this Plan, in which event ASTAK Services Company will refund the full amount paid, less the retail value of any services rendered; or (B) at any time after sixty (60) days after receipt of this Plan, in which event ASTAK Services Company will refund the full amount paid, reduced by (I) the retail value of any services rendered, (ii) a pro rata amount based on elapsed time, and (iii) an administration fee equal to the lesser of ten percent (10%) of the cost of the Plan or Twenty-five Dollars ($25). The Customer's copy of this Agreement should be returned to ASTAK Services Company with the written notice of cancellation. (b) BY ASTAK SERVICES COMPANY, (A) if any serial number(s) of any product(s) has been defaced, altered or removed, (B) if during the term of this Agreement, any product has been serviced by any person or organization not authorized by ASTAK Services Company, (C) if any product is used for unauthorized commercial purposes, (D) if any installment payment is not made when due and remains unpaid for five business days thereafter. In the event of termination under this Paragraph 3 (b), if the purchase price has been paid in full, ASTAK Services Company will refund a prorated amount based on the unexpired term compared to the full term of the Plan. (c) BY ASTAK SERVICES COMPANY if (1) repair parts to restore the product to factory specifications become unavailable and (2) Customer, after notification of the level of repair that can be achieved, rejects such repair. In that event ASTAK Services Company will refund the full amount paid for the current Customer Care Plan, and will have no further liability or responsibility to Customer.

·Customer certifies that the information provided concerning each product is true and correct.

This Agreement is transferable to a new owner of unit specified in this Agreement provided that the present owner requests such transfer in writing to ASTAK Services Company.
